I am currently in the process of purchasing my first apartment in Sofia and am feeling overwhelmed by the legal requirements surrounding the Notarialen Akt. Could someone please explain the step-by-step role of the notary during the final signing phase and what specific documents I should have prepared beforehand? I am particularly concerned about how to verify that the property is free of any existing encumbrances or mortgages. Any advice from expats or locals who have recently gone through this transaction would be greatly appreciated.

Congratulations on the new apartment! The notary’s role is primarily to verify the identities of both parties, ensure the deed complies with legal requirements, and confirm that all taxes are paid. My best advice is to read this guide on buying property in Bulgaria, which covers the document checklist extensively.

Don't worry, the notary will actually perform a 'Certificate of Encumbrances' check at the Registry Agency before the signing. This document officially proves if there are any mortgages or legal claims against the apartment. Just make sure your lawyer has vetted the seller's documentation beforehand.

You should have your passport, the preliminary contract, and proof of payment prepared. The notary will check the 'Act 16' status as well. If you are unsure what that is, check out this article on why Act 16 is crucial for your investment safety.

I went through this in Sofia last year. My tip: hire an independent lawyer who is not associated with the seller's agency. They will handle the 'check for encumbrances' at the Property Register for you, which is the safest way to ensure the title is clean.

The notary is a neutral party representing the law, not you. They are there to legalize the transfer, not to protect your specific interests. Always have a lawyer present to double-check the Notarialen Akt draft before you actually sign it in the notary's office.

Are you a non-EU citizen? If so, the process for buying land vs. just an apartment is different. Make sure you check the specific legal requirements for your citizenship status before you reach the signing phase.

The notary will ask for the tax assessment (danachna otsenka) and the cadastral sketch (skitsa) of the property. The seller usually provides these, but you must ensure they are current. If they are older than a few months, the notary won't proceed.

It feels overwhelming, but it’s a very standardized process in Bulgaria. Once the notary verifies the documents and both parties sign, they electronically submit the deed to the Registry Agency. You usually get the official copy a few days later.

Make sure you confirm the payment method with the notary in advance. Most transactions in Sofia are done via bank transfer, and the notary will need the proof of payment to finalize the deed execution.
